If Allah merely just wanted us to follow the Qur'an (and I realize you believe in hadith, so you know what I mean) then why send it through a messenger and tell us to obey the messenger (mind you, the Qur'an is Allah's direct words).

The Qur'an is not the be all end all. For example, the Qur'an explicitly states one of the integrals of wudu' is washing the feet. No one contends that. But there are hadith that allows to wipe over the khuff. Is this a contradiction? Do we leave the hadith and say such a wudu' is not valid because one has not washed the foot? Of course not. Shaykh Faraz put it nicely once and stated that hadith serve as a foot note to the Qur'an. We have to balance them out through principles.

And consider, what good is using the Qur'an as a guide if there's no method to interpretation? One of the most important purposes of law is to inform people in advanced of what to expect from the legal system. There needs to be definition, principles, criteria, etc to determine how to interpret the Qur'an.

Anyways, developing an Islamic legal system is not only necessary, but inevitable. Mind you, it was something that developed over time as needed. When Islam started to spread, many new questions arose that could not be directly addressed by the Qur'an or even the sunnah. Don't forget that many legal rulings are a result of questions that scholars received. And of course scholars can't just make it up as they go along and read the Qur'an how they personally deemed fit. A system had to develop and that's what happened.

So ya, the idea is overly simplistic basically because it does not address the needs of our society and it would leave room for too much inconsistency.

Hope that helps?
JazakAllah Khair I knew what you were going to say but I was hoping what you said would be of benifit to others. I'm not in a position to agree nor disagree with you as I really need to study the Quran and Hadith more and talk to some knowledgable folks and pick their brains.

I am just afraid of the Muslims going down the same path as the Jews and Christians.

Actually i didn't but thatnks.

Salika don't want the Muslims to folow the same path in the respect that Jews strayed of the path of the Tawrah by introducing a lot of nonsensicle Rabbincal traditions.

I pray this never happens to us insha'Allah.
