In that case, the new contract would be valid but the old one (and the time they spent in the old one) was invalid. So long as there's a specified expiry date to the contract then it's invalid.

And sure insha'allah, I'll remember you in my dua's If there's something specific you want me to make dua' for, PM me right now (I'm putting my dua' list together...).
Thanks bro for clearing it up. If what you say is correct, then Misyar seems like a better thing than Muta, which is simply prostitution.

Is misyar what the Prophet (saw) allowed during war time when soldiers were away from home for months? Because the Shia seem to claim that it was "mutaa" that the Prophet (saw) allowed and then Umar r.a. banned it due to its misuse ...

JazakAllah

Isn't there a rule that one can't remarry someone right after divorcing them?

was-Salaam
I've heard that too. One must be married to someone else first before remarrying an old ex is what I've heard. I wonder what the fiqh and reasoning is for that.

Okay, never mind - I found out from sunnipath that it was actually Muta that was banned and that it was banned by the Prophet saw himself and not Umar r.a. as the Shia claim.
Temporary marriage

And sunnipath also discusses misyar - I should have checked this earlier! But sunnipath does not go into the history of misyar i.e. when and why did it start and what did the Prophet saw say about it.

I've heard this all my life. Except, my version was from a devout, almost fundamentalist type Sunni friend. He gave me all kinds of "scholars" works and things saying Umar was the one that banned it. I told him, alright cool, and then went back to work.

I don't think that Sunnis claim that Umar r.a. banned it rather the ban was enforced during his time rigorously as were other things like zakat etc, so your friend was probably wrong ... and i dont know what you mean by a fundamentalist ...

In ithne asheri shi'a fiqh is there a minimum time restriction for mut'ah?
i.e. Can a shi'ah go and have mut'a with a person for an hour or so?

was-Salaam

If i wanted to do something, then a technicality like a misa or misyaa or muta wouldn't stand in my way.

In a misyar marriage there's an understanding that the marriage will come to an end eventually - but not necessarily so, as the couple could change their minds.
Where did you get that from?

The contract doesn't state anything to that effect, and 'marrying' with the intention to divorce (later) is unacceptable according to all Sunni schools of fiqh as far as I'm aware. Could you clarify on this? JazakAllah.

Don't be stupid. As you know a dower is also a requirement for (permanent) marriage...but would you say "O did you pay her to marry you?"

The Prophet's companions only used wheat or flour or another ascetic commodity as a dowry when they did mutah.
