Hard to determine without a fair trial don't you think? GITMO and the military tribunal process these "enemy combatants" face are a legal travesty. Anyways...I'm not sure why I respond to your posts. I know it's silly of me to expect you to think critically.
For anyone interested in some of the shenanigans related to this case.

how can someone be 'guilty' of killing a soldier? that would make him a prisoner of war, not a criminal. so why isn't he being treated as a prisoner of war?
i understand he's alleged to have killed a medic, but a) he hasn't gotten a war crimes trial, and b) it was with a grenade to begin with, so the intent to kill the medic specifically is somewhat difficult to establish, i'd imagine.

Psssssshhhhtt......that's not important sixpakistan.
What matters is that King Bush the Second (and his congress of jesters) have eliminated the need for those pesky subtleties of international law governing prisoners of war and now the US can do whatever it pleases with these "enemy combatants", including but not limited to; unlimited detention without trial, torture, withholding evidence and other cool stuff.
All hail the supreme leader!!!

His and the status of all who are engaged in fighting against NATO in Afghanistan has been the subject to much debate, look it up

It may well be so.
My original comment was really just to counter what I perceived as a "he's only sixteen, poor fellow" plea

So now it's a crime to throw a grenade at an armed foreign invader, occupier, and colonial soldier inside of your OWN country?
He should get a medal of honor for that. It's called freedom fighting.

A Canadian Security Intelligence Services agent in the video grills Khadr about events leading up to his capture as an enemy combatant when he was 15. Khadr, a Canadian citizen, is accused of throwing a grenade that killed a U.S. soldier during a 2002 firefight in Afghanistan. He was arrested after he was found in the rubble of a bombed-out compound — badly wounded and near death.
Do you need further explanation?

If he was an American citizen, then I could see a problem. But he is Canadian, so there is no issue.
Anyways, I guess you are right: what right do Canadians have to be in the country of the Muslims...unless they come with guns, tanks, planes, bombs, etc., right?

Re: Gitmo interrogation video released
Citizens really should stay out of the firefight. Once you get involved in it, you should expect to be treated as a combatant.
That said, if he hasn't gotten the prisoner of war treatment, that's what needs to be corrected.
