Misyar fulfills the technical requirement of the Islamic definition of marriage, even if it seems to contradict the spirit/intent of marriage. Mut'ah fails on both accounts.
Having said that, I probably agree with the Scholar's who declared misyar haram (though there have only been a few of them). However I don't believe it's legitimate to hold the scholar's who don't declare it haram as responsible for it. Instead I respect their taqwa and fear of saying something is haram without stronger proof...rather I think the people who are stupid enough to do it are the one's responsible for it.
