Depends -- I know that at least some shia have "seafood laws" and do not interpret the Qur'anic verses stating that creatures of the water are lawful as meaning ALL water creatures without exception. In general, muslims who observe seafood laws do not eat shellfish, may not eat fish that have no scales, and say that a fish has to be caught alive by a muslim or at least a person of the book in order for it to be halaal.
Incidentally, this is also the reasoning (to my knowledge) behind why some people consider shrimp to be makruh -- it dies very quickly after being caught if removed from water and you generally don't know if the fisherman was a muslim.
